General Headnotes and Rules of Interpretation

2. Statistical Annotations. (a) The statistical annotations to the Tariff Schedules of the United States consist of -

and

(i) the 2-digit statistical suffixes, (ii) the indicated units of quantity, (iii) the statistical headnotes and annexes, (iv) the italicized article descriptions. (b) The legal text of the Tariff Schedules of the United States consists of the remaining text as more specifioally identified in headnote 10(a) of the general headnotes and rules of interpretation.

(c) The statistical annotations are subordinate to the provisions of the legal text and cannot change their scope.

(a) General Rule:

3. Statistical Reporting Number. Except as provided in paragraph (b) of this headnote, and in the absence of specific instructions to the contrary elsewhere, the statistical reporting number for an article consists of the 7-digit number formed by combining the 5-digit item number with the appropriate 2-digit statistical suffix. Thus, the statistical reporting number for live monkeys dutiable under item 100.95 is "100.9520".

(b) Wherever in the tariff schedules an article is classifiable under a provision which derives its rate of duty from a different provision, the statistical reporting number is, in the absence of specific instructions to the contrary elsewhere, the 7-digit member for the basic provision followed by the item number of the provision from which the rate is derived. Thus, the statistical reporting number of mixed apple and grape juices, not containing over 1.0 percent of ethyl alcohol by volume, is "165.6500-165.40".

4. Abbreviations. (a) The following symbols and abbreviations are used with the meanings respectively indicated

below:

(b) An "x" appearing in the column for units of quantity means that no quantity (other than gross weight) is to be reported.

(c) Whenever two separate units of quantity are shown for the same article, the "y" following one of such units means that the value of the article is to be reported with that quantity.

2. Each and every gauge or wine gallon of measurement is counted as at least one proof gallon; and the standard for determining the proof of brandy and other spirits or liquors of any kind when imported is the same as that which is defined in the laws relating to internal revenue. The Secretary of the Treasury, in his discretion, may authorize the ascertainment of the proof of wines, cordials, or other liquors and fruit juices by distillation or otherwise, when it is impracticable to ascertain such proof by the means prescribed by existing law or regulations.

3. For the purposes of this subpart

(a) the term "gallon" in the "Rates of Duty" column of the provisions applicable to fruit juices means gallon of natural unconcentrated juice or gallon of reconstituted juice;

(b) the term "reconstituted juice" means the product which can be obtained by mixing the imported concentrate with water in such proportion that the product will have a Brix value equal to that found by the Secretary of the Treasury from time to time to be the average Brix value of like natural unconcentrated juice in the trade and commerce of the United States; and

(c) the term "Brix value" means the refractometric sucrose value of the juice, adjusted to compensate for the effect of any added sweetening materials, and thereafter corrected for acid.
