No. 5. The declaration against Popery, 30 Car. 2. St. 2. c. 1.

I do solemnly and sincerely in the presence of God confess, testify, and declare, that I do believe that in the sacrament of the Lord's Supper there is not any transubstantiation of the elements of bread and wine into the body and blood of Christ, at or after the consecration thereof by any person whatsoever; and that the invocation or adoration of the Virgin Mary or any other saint, and the sacrifice of the mass as they are now used in the church of Rome, are superstitious and idolatrous. And I do solemnly in the presence of God, profess, testify, and declare, that I do make this declaration and every part thereof in the plain and ordinary sense of the words read unto me, as they are commonly understood by English protestants, without any evasion, equivocation, or mental reservation whatsoever, and without any dispensation already granted me for this purpose by the pope, or any other authority or person whatsoever, and without any hope of any such dispensation from any person or authority whatsoever, or without thinking that I am or can be acquitted before God or man, ́or absolved of this declaration or any part thereof, although the pope or any other person or persons, or power whatsoever, shall dispense with or annul the same, or declare that it was null or void from the beginning.

Instead of the oaths of allegiance and supremacy, Quakers are allowed to make the following declaration of fidelity; by the 8 Geo. 1. c. 6.

No. 8. Declaration of Fidelity.

I do solemnly and sincerely promise and declare, that I will be true and faithful to king George; and do solemnly, sincerely and truly profess, testify and declare, that I do from my heart abhor, detest and renounce, as impious and heretical, that wicked doctrine and position, that princes excommunicated or deprived by the pope or any authority of the see of Rome may be deposed or murthered by their subjects or any other whatsoever. And I do declare, that no foreign prince, person, prelate, state or potentate, hath or ought to have any power, jurisdiction, superiority, pre-eminence or authority, ecclesiastical or spiritual, within this realm.

No. 9. Quakers Abjuration ought to be thus, by 8 Geo. 1.

do solemnly, sincerely and truly acknowledge, profess, testify and declare, that king George is lawful and rightful king of this realm, and of all other his dominions and countries thereunto belonging; and I do solemnly and sincerely declare, that I do believe that any of the descendants of the person who pretended to be prince of Wales during the life of the late king James the second, and since his decease pretended to be and took upon himself the style and title of king of England by the name of James the third, or of Scotland by the name of James the eighth, or the style and title of king of Great Britain, hath any right or title whatsoever to the crown of this realm, or any other the dominions thereunto belonging, and I do renounce and refuse any allegiance or obedience to any of them. And I do solemnly promise that I will be true and faithful, and bear true allegiance to king George, and to him will be faithful, against all traitorous conspiracies and attempts whatsoever which shall be made against his person, crown or dignity. And I will do my best endeavour to disclose and make known to king George, and his successors, all treasons and traitorous conspiracies, which I shall know to be against him or any of them. And I will be true and faithful to the succession of the crown against the descendants of the said James, and against all other persons whatsoever, as the same is and stands settled by an act, intituled, " An Act declaring the rights and liberties of the subject, and settling

the succession of the crown, to the late queen Anne, and the heirs of her body being protestants:" and as the same, by one other act, intituled, "An Act for the further limitation of the crown, and better securing the rights and liberties of the subject," is and stands settled and entailed, after the decease of the said late queen; and for default of issue of the said late queen, to the late princess Sophia, electress and duchess dowager of Hanover, and the heirs of her body, being protestants. And all these things I do plainly and sincerely acknowledge, promise and declare, according to these express words by me spoken, and according to the plain and common sense and understanding of the same words, without any equivocation, mental evasion, or secret reservation whatsoever. And I do make this recognition, acknowledgment, renunciation, and promise, heartily, willingly and truly, upon the true faith of a Christian.

So help me God.

No. 10. The Quakers' Profession of their Belief, by 1 W. & M. sess. 1. c. 18. s. 13.

I

profess faith in God the Father, and in Jesus Christ his eternal Son, the true God, and in the Holy Spirit, one God, blessed for evermore; and do acknowledge the holy scriptures of the Old and New Testament to be given by divine inspiration.

No. 12. The like, for taking and framing unlawful Oaths at Common Law.

[For unlawfully, wickedly, and seditiously meeting together with divers other persons, and consulting, advising, and agreeing to compose and frame a certain unlawful oath and engagement, purporting to bind the persons taking the same to commit treason and murder, with intent to take the same themselves, and feloniously to administer the same to divers liege subjects of our lord the king,] against the peace, &c. Therefore, &c.

No. 13. The like, for aiding and assisting at the administering an unlawful Oath.

[For unlawfully and feloniously being, aiding, and assisting at, and consenting to, the administering and taking of an oath or engagement, purporting and intending to bind

the person taking the same to be of an association, society, and confederacy, formed to disturb the public peace, and not to inform and give evidence against any associate, confederate, or other person, and not to reveal or discover a certain unlawful combination and confederacy, and not to reveal and discover a certain illegal act done,] against the peace, &c. and against the statute, &c.

No. 14. The Oath to be administered to a Witness who is a Scotch Covenanter. (For other Oaths, see tit. VOTE, Chitty's C. L. p. 320, &c.

do swear by God himself, as I shall answer to him at the great day of judgment, that the evidence I shall give to the court and jury touching the matter in question, shall be the truth, the whole truth, and nothing but the truth. So help me God.

No. 15. The like, in another form.

You swear, according to the custom of your country and the religion you profess, that the evidence you shall give between our sovereign lord the king and the prisoner at the bar, shall be the truth, the whole truth, and nothing but the truth. So help you God.

No. 16. The mode of administering an Oath to Gentoo Witnesses.

Subjects of the great Mogul may be sworn in the following

manner :

The witnesses being present with a bramin or priest of the Gentoo religion, the oath prescribed to be taken by them must be interpreted to each witness respectively; after which they severally with their hands touch the foot of the bramin or priest of the Gentoo religion being also present, with another bramin or priest of the same religion; the oath prescribed to be taken is then interpreted to him, and then he touches the hand of the bramin or priest.

No. 17. The like, of an Interpreter, to a Deaf and Dumb Witness.

You shall well and truly interpret to

here produced on behalf of the king against

No. 18. The like, to an Interpreter in general.

You shall true interpretation make of the evidence between the court and jury, and the prisoner at the bar, according to the best of your skill and understanding, So help you God.
