which said sum of I, the said justice, do award the said A. B. to pay to the said C. D. the party grieved, as a reasonable satisfaction for his damage and costs, which said sum of is now here demanded by the said C. D. of the said A. Another Form of an Order of one Justice for not paying a Hackney Coach fare, under 9 Ann. c. 23. s. 2. City and Liberty of Westminster, to wit. Whereas information and complaint hath been made unto me W.R. one of his majesty's justices of the peace in and for the city and liberty of Westminster, by A. B. driver of the hackney coach numbered 356, that one C. D. had unlawfully refused and neglected to pay him the said A. B. as such driver as aforesaid, the sum of as and for the fare and hire of the said chariot on the day of last past, for time in the parish of in the said city and liberty, and as being the money justly due to the said A. B. as such driver as aforesaid for carrying and conveying the said C. D. in the said chariot on the said to the statute in such case made and provided. And whereas the said C. D. having appeared before me to answer the said complaint, and the truth thereof having been satisfactorily proved before me by the said A. B. on the instant at day of in the parish of contrary day of in the said city and liberty, that he had not paid the said sum of or any part thereof, or showed to me any just cause why the said fare for the hire of the said chariot should not be paid. I, therefore, having duly and justly examined into the truth and matter of the said complaint, and upon due consideration had thereof, do hereby adjudge, order, and award that he the said C. D. do and shall pay to the said A. B. as such driver as aforesaid the said sum of as the money justly due to him the said A. B. for the cause aforesaid, and also the sum of for the reasonable costs incurred in attending the prosecution of the said complaint by the said A. B. which said damage and costs being at the time and place last mentioned demanded of the said C.D. and he having refused and neglected to pay or make reasonable satis faction for the same, I, the said justice, did then and there, in pursuance of the said statute in such case made and provided, bind over the said C. D. to the next general quarter sessions of the peace to be held for the said city and liberty, to abide such order and adjudication as may be then and there made in the matter by the justices to be then and there assembled. BEFORE any person can obtain a licence to trade or travel from town to town, or to other men's houses, either on foot or with horse or horses, either by opening a room or shop, and exposing goods, wares, or merchandises to sale by retail, in any town, parish, or place, not being a householder there, or the same not being his usual place of abode, or by any other means, or device, to vend or sell either by himself, or by any auctioneer, whether licensed or not, broker, appraiser, agent, servant, or other person in his behalf, any goods, wares, or merchandises whatever, by outcry, knocking down at hammer, candle, lot, parcel, or any other mode of sale at auction, whereby the best or highest bidder is decreed to be the purchaser, he must produce to the commissioners for licensing and regulating hackney coaches, a certificate signed by some one clergyman officiating within the parish, chapelry, or place where the person so applying has his usual place of residence; and also by two respectable inhabitants of the same place, attesting that such person is of good character and reputation, and fit to be licensed to exercise the trade of a hawker, pedlar, and petty chapman; 50 Geo. 3. c. 4. s. 12. D. late of hawker of [describe the goods sold, or at least particulars to shew that he was a hawker or travelling trader,] did on the instant, at the parish of day of in the said county, travel and trade under colour of a license, [or, as the case may be,] without causing to be written, painted, or printed, in large legible Roman capitals, upon the most conspicuous part of every pack, box, bag, trunk, case, and cart, [or waggon, or other vehicle, or conveyance,] in which he carries his goods, wares, and merchandize, [or, upon the most conspicuous part of the room and shop in which he so trades, or, upon every hand bill or advertisement which he gives out, distributes, or publishes,] the words 'LICENSED HAWKER,' together with the number, name, or other mark or marks of distinction so written or printed upon his license as aforesaid, contrary to an act of parliament passed in the fiftieth year of his late majesty king George the third, intituled, ‘An Act for placing the duties of hawkers and pedlars under the management of the commissioners of hackney_coaches,' whereby and by force of the said statute the said C. D. has forfeited the sum of ten pounds for his said offence, to be distributed as the law directs, according to the form of the statute in such case made and provided; whereupon the said A. B prays judgment of me the said justice in the premises, and that the said C. D. may be summoned to appear before me the said justice, to answer unto the said complaint, and make defence thereto. in the county of hawker.
