ble, funds from this appropriation may be used to reimburse sponsors of nonprofit school lunch, special school milk or other school child feeding programs to the extent that federal funds apportioned to the state of New York are insufficient to provide the full reimbursement to which such sponsors may be entitled pursuant to the provisions of school lunch, special school milk or other school child feeding program agreements entered into by the state education department and such sors, in accordance with either the provisions of an act of Congress entitled the "National School Lunch Act" (P. L. 79-396) or any amendment or amendments thereto or the provisions of the Child Nutrition Act of 1966 (P. L. 89-642) or any amendment thereto in the case of school breakfast programs to reimburse sponsors in of the federal rates of reimbursement. The commissioner of education is hereby authorized and empowered on behalf of the state or the state education department to make and sign any agreements that may be necessary or proper for the establishment, maintenance, operation or expansion of school lunch, school breakfast, special school milk or other school child feeding programs now in effect or hereinafter established, and to provide for apportionments, and loans or advances and repayments thereof, including three million seven hundred eighty thousand eight hundred sixty dollars ($3,780,860) for a program of breakfasts including hot breakfasts and for a program of free lunches for indigent pupils as defined by the commissioner of education in connection with such programs, and he is further authorized and empowered to do and perform any act that may be necessary or proper to carry out the purposes and objectives of such programs or agreements.

The department of taxation and finance shall accept and receive any and all apportionments, allocations or grants awarded to the state under or pursuant to any federal law or regulation for school lunch, special school milk or other school child feeding programs. The moneys so received shall be deposited by the department of taxation and finance in a separate fund or funds and shall be used exclusively for

the purposes for which any such moneys
shall be offered under or pursuant to any
federal law or regulation. Such moneys
shall be paid from such fund or funds un-
der rules and regulations to be adopted by
the regents upon the recommendation of the
commissioner of education and subject to
the approval of the director of the budget
and on the audit of the comptroller upon
vouchers certified or approved by the com-
missioner of education.

The moneys hereby appropriated, or so much.
thereof as may be necessary, are to be
available for the purposes herein speci-
fied for obligations heretofore accrued or
hereafter to accrue for the school years
beginning July first, nineteen hundred
eighty-three, July first, nineteen hundred
eighty-four and July first, nineteen hun-
dred eighty-five

for a reduced price lunch by fifteen cents

For allowances to private blind and deaf
schools, including state aid for blind and
deaf pupils in certain institutions to be
paid for the purposes provided by article
85 of the education law including one hun-
dred fifty thousand dollars ($150,000) for
the education of deaf children under three
years of age. Notwithstanding any other
inconsistent provisions of law, such aid
shall be for the New York state pupils ap-
proved to attend such schools and whose
admissions, attendance and termination
therein is in accordance with rules and
regulations of the commissioner of educa-
tion. The commissioner shall determine by
rules and regulations, as approved by the
director of the budget, the definition of
aidable operating expenses and shall fur-
ther require

aid will be for the New York state pupils
approved to attend such schools, and whose
admission, attendance and termination
therein is in accordance with regulations
of the commissioner of education. The com-
missioner shall determine by regulations,
as approved by the director of the budget,
the definition of aidable operating ex-
penses and shall further require such in-
formation at such times as he deems neces-
sary in order to determine aidable operat-
ing expenses. This appropriation shall be
for the current school year and the ensu-
ing school year, and each private school
shall receive an amount not to exceed the
approved tuition rate for each state ap-
pointed pupil, to be paid according to
payment schedule determined by the commis-
sioner of education and approved by the
director of the budget
