hospital based free-standing general med-
ical clinics under the primary ambulatory

Grants or contractual
payments made pursuant to this program
shall not be available to general medical
clinics operated
operated by local health depart-
ments and shall not be available to other
providers and their affiliates eligible
for payments pursuant to subdivision 9 of
section 2807-a of the public health law
except that nothing herein shall prevent
the commissioner, subject to the approval
of the director of the division of the
budget, from providing targeted capitation
or direct grant support to any general
medical clinic other than those operated
by local health departments, for the pur-
pose of adding or expanding medical ser-
vice in a geographic area where the com-
missioner deems such action necessary
