An Ordinance for the Inspection of Flax Seed,

(Passed August 4, 1818.)

I. Be it ordained by the Common Council of the Borough of Norfolk in Common Hall assembled, That from and after the first day of September, one thousand eight. hundred and eighteen, all Flax Seed exported from this Corporation shall be submitted to the view and examination of an Inspector, to be appointed as hereinafter directed, whose duty it shall be carefully to examine and inspect the same agreeably to the regulations contained in this Ordinance.

II. And be it further ordained, That from and after the first day of September, 1818, it shall not be lawful for any person whomsover, to export, ship or lade from this Corporation, on board any ship or vessel for exportation, any Flax Seed, unless the same be well cured, sound and merchantable, packed in casks made of oak staves, sound and well seasoned, having a lining hoop on round the chines and twelve other good hoops nailed with four nails in each chine hoop, and four nails in each upper bilge hoop, sufficient in, every respect to hold Flax Seed, and of the following dimensions, towit: The length of the staye to be thirty-two inches, the diameter of the head to be twenty three inches, and the canting pieces of one head, of each, to be of seasoned oak, and to contain seven bushels Flax Seed, or in casks of thirty-two inches in the length of the stave, and the diameter of each head seventeen inches, tight

IV. And be it further ordained, That every cask containing Flax Seed, which shall be of the dimensions, and made in the manner required by this Ordinance, and which, according to the Inspector's best judgment, is merchantable and fit for exportation, shall be, by the said Inspector, branded on the head thereof with public brand-marks to be by him proved for that purpose, and with letters at least three fourths of an inch Length of in length, with the words "Norfolk Flax Seed," and no Inspector shall brand any cask of Flax Seed which he may think unsound or unmerchantable, but shall Unmerchantcause the same to be marked on the bilge with the Broad Arrow, or secure it for further examination if required; which examination the owner shall procure to be made within the space of four days; and the said Inspector shall and may demand, and receive from the owner or owners thereof, the same ratio as if the same had been branded. V. chantable, then, and in that case, the said Inspector shall put such brand on the cask, containing the said Flax Seed, as they or any two of them may adjudge and determinę, and the Corporation shall be allowed six cents per cask for storage, if stored. And if upon an appeal and review as aforesaid, the judgment of the Inspector shall be confirmed, the person appealing shall pay the expense of such storage, and shall also pay the same if an appeal shall not be prosecuted. And if the judgment of the said Inspector shall be reversed, then the Corporation shall defray the charge of the storage.

VI. And be it further ordained, That if any person shall counterfeit any brand belonging to or used by said Inspector, or shall empty any cask containing any Flax Seed inspected and branded as by this Ordinance is required, and put in other Flax Seed without first cutting out said brand, and with intent to defraud, the person or persons so offending shall forfeit and pay twenty dollars for each and every offence.

VII. And be it further ordained, That the Common Council shall annually appoint an Inspector of Flax Seed, who shall, before he enters on the duties of his office, take out a license from the Mayor, under his hand and seal, for which he shall pay to the Collector, for the use of the Corporation, the sum of twenty-five dollars, and make oath or affirmation before the Mayor, that he will faithfully execute the duties of his office, agreeably to the directions of this Ordinance, and according to the best of his skill and ability.

VIII. And be it further ordained, That the said Inspector shall keep an account of the number of casks of Flax Seed by him inspected, and once in every three months, make a return thereof, on oath or affirmation, to the Inspector of the Corporation. And further, that no Inspector shall purchase himself or be concerned in the purchase of any Flax Seed brought to the said Corporation for sale, under the penalty of ten dollars.

IX. This Ordinance shall commence and be in force from and after the first day of September next, and all Ordinances coming within the purview of this Ordinance, shall be, and they are hereby repealed,

An Ordinance to amend the Ordinance respecting
Flax Seed.

(Passed August 3, 1820.)

I. Be it ordained by the Common Council of the Borough of Norfolk, That Flax Seed, in order to be merchantable, shall be clean, and that the tax of twentyfive dollars per annum imposed on the Inspector shall be taken off.

II. This Ordinance to commence from and after the passing thereof.

GAMING.

An Ordinance to restrain Gaming within the Borough of
Norfolk.

(Passed August 15, 1818.)

I. Be it ordained by the Common Council of the Borough of Norfolk in Common Hall assembled, That if any person or persons shall at any time, in any ordina- Gaming at ry licensed house of entertainment, within the Borough Ordinaries. aforesaid, or in any house attached thereto, or upon the lot or premises whereon such licensed house is or may be situate, or erected, play at any game, or games whatsoever, except bowls, quoits, backgammon, chess, Exceptions, shuffle board, or draughts, or shall bet on the sides or hands of such as do game, every such person or persons, on conviction thereof, shall forfeit and pay ten dollars; and if any ordinary keeper shall suffer or permit any person to play as aforesaid at any time in his house, at any game or games, except as aforesaid, and knowing the same, shall forfeit and pay for every such offence the sum of twenty dollars.

II. And be it further ordained, That any person or persons, who shall, within the Borough aforesaid, set up, keep, or maintain any E O, A B C, Faro Table, Faro Bank, or device, or game of hazard, or address, for the purposes of public gaming, in any dwelling house, out house, or place occupied by any private individual, tavern keeper, or retailer of spirituous liquers, and every person or persons, who shall play at

such game, device, bank, or tables, or shall bear a share or part in any stake, wager, or adventure played for, or shall bet on the side of any person or persons who shall so play, each and every person herein offending shall, for every offence, forfeit and pay fifteen dollars, on conviction thereof, and the occupier or occupiers of such house, out house, or place, shall forfeit and pay twenty dollars, for each and every time such gane is played.

III. And be it further ordained, That it shall be the duty of the Constables, within the Corporation aforesaid, to give information to the Mayor, or other Magistrate, of each house or other place, within the Corporation, aforesaid, wherein such games, or devices, or tables, for the purposes aforesaid, are or may be set up, kept, or maintained, and the said Constables shall take all lawful means to suppress and prevent the playing at the tables, games or devices aforesaid, and for this purpose, when, and as often as they, or either of them, shall have reasonable cause to suspect, that any such tables, games, or devices are set up, kept or maintained, as aforesaid, they, or either of them, sball apply to a Magistrate for a warrant, and shall state under oath, the cause of such suspicion, whereupon the said Magistrate shall, in his discretion, grant a warrant to said Constable, or Constables, authorising him or them, to enter such house, houses, or place, or any room within the same, and the said Constable or ConMay demand stables shall thereupon have authority to demand entry therein, and any person or persons who shall refuse, for neglect, to open the door, or entrance of such house, houses, or places, or any room within the same, upon the application of the said Constable or Constables, he, she, or they, so offending shall forfeit and pay twenty dollars.

IV. And be it further ordained, That no match or main of cocks shall be fought within the Corporation aforesaid; and if any match or main of cocks shall be fought within the said Corporation, any person who shall trim, heel, pit, or hand any cock so fought, and every owner of any such cock consenting thereto, and every person who shall bet on such match or main, shall severally forfeit and pay for every such offence the sum of twenty dollars.
