Noncompliance with the terms of this Decree will be punished by a fine which may extend to five times the amount of the fees due to the Government under this Decree.

All documents defining or creating any legal right or duty of which no money value can be expressed shall bear a 10 rupee stamp.

WHEREAS Her Majesty's Acting Commissioner for East Africa has made certain Regulations* for the stamping and legalization of documents within the territories of the East Africa Protectorate exclusive of the Sultanate of Witu.

It is hereby enacted, by order of His Highness the Sultan of Witu, that the aforesaid Regulations, a copy of which is hereto attached, shall apply on and after the 7th day of November, 1896.

Given at Mombasa under my hand and seal this 15th day of October, 1896.

WHEREAS it is expedient that a register should be kept of persons dying within the Protectorate.

Now it is hereby ordered that every executor, wazee or other person responsible for the distribution of the property of any persons dying after this date or any person who inherits property through the death of any person shall give notice of the death at the office of the Sub-Commissioner of the district wherein the death occurs, and wherein any property of the deceased may be situate.

NOTICE respecting Slaves of persons dying within the East Africa Protectorate. Mombasa, December 19, 1896.

THE attention of executors, wazees and others responsible for the distribution of the property of deceased persons is called to paragraph No. 4 of the Proclamation* dated the 1st August, 1890: viz., that slaves may be inherited at the death of their owner only by the lawful children of the deceased. If the owner leaves no such children his slaves shall ipso facto become free on the death of their owner.

In case any one possessed of slaves dies without leaving children it is the duty of the executor, wazee or other person. or persons responsible for the distribution of his estate to bring his slaves before the Court in order that they may receive

their freedom papers. Any neglect of this duty will be severely punished.

ORDER as to the Registration of Documents in the East Africa Protectorate. Mombasa, December 21, 1896.

WHEREAS by Order dated the 1st of June, 1893, registration was required of all documents relating to leases, mortgages, sales, and other transfers of immovable property, except wills.

And whereas there is reason to believe that in many cases the above Order has not been complied with.

Now it is hereby ordered as follows, viz. :—

1. All documents required by the aforesaid Order to be registered must be left for registration within two months from the date of this Order.

2. All similar documents executed, on or after the date of this Order, must be registered within two months from the date of their execution.

3. If any document is not registered within the period prescribed by this Order the person in whose favour the document is drawn will be liable to a penalty of 500 rupees in addition to the proper stamp duty.

4. Documents that require registration must be either registered at the principal office of the Protectorate in Mombasa or in the registry of the district within which the land affected is situate.

SCHEDULE.

Leases.

1. When the rent is fixed and no premium paid the duty on a lease for less than one year shall be calculated on the whole of the rent reserved at the following rate :

4. The duty payable upon a lease for an indefinite shall be calculated upon an amount equal to the average annual rent for 10 years at the same rate as for a lease for a term of more than three years.

5. When a lease is granted for a fine or premium and no rent is reserved the duty shall be calculated on the amount of premium at the same rates as for a lease for a term of more than three years.

6. When a lease is granted for a fine or premium in addition to rent, duty will be charged both upon the premium and rent.

Mortgages and Deposit of Title Deeds.

7. When at the time of the execution of a mortgage possession of the property or any part thereof is given or agreed to be given by the mortgagor, duty shall be paid at 1 per cent. upon the amount of money secured by the mortgage deed.

8. In all other cases the duty payable shall be calculated upon the amount of the money secured by the mortgage deed at the following rates:

9. A reconveyance of a mortgage when the amount of the loan advanced does not exceed Rs. 1,000 shall bear a stamp equal to the amount of stamp duty payable in respect of the mortgage.

In all other cases the reconveyance shall bear a stamp of Rs. 10.

Pledges.

10. An instrument evidencing an agreement to secure the repayment of a loan made upon the deposit or hypothecation of any property shall bear a stamp calculated upon the loan at the following rate:

(a.) If the loan is repayable after more than one year from the date of such instrument :
