Kingston upon Hull Provisional Order.

A.D. 1927. with the provisions of the Public Health Act 1875 relating to Provisional Orders amending Local Acts and in the application of those provisions to the purposes of that Section the Secretary of State shall be substituted for the Local Government Board or the Ministry of Health;

And whereas the Corporation have applied to the Secretary of State for the issue of a Provisional Order to continue in force the provisions of Section 4 of the Local Act of 1907 for a further period :

Now therefore I the Right Honourable Sir William Joynson- 10 Hicks Baronet one of His Majesty's Principal Secretaries of State in pursuance of the powers given to me by Sections 297 38 & 39 Vict. and 303 of the Public Health Act 1875 as applied by subsection (5) of Section 4 of the Local Act of 1907 and of all other powers enabling me in that behalf hereby order that from and after the 15 date of the Act of Parliament confirming this Order the following provisions shall take effect namely:

Art. I. Notwithstanding anything contained in Section 4 of the Local Act of 1907 the provisions of this Section shall continue to be in force in the City until the Thirty-first day of 20 December One thousand nine hundred and thirty-seven.

Art. II. This Order may be cited as the Kingston upon Hull Order 1927.

Amend the law relating to the sale and supply of intoxicating liquors to bonâ fide travellers.

E it enacted by the King's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, 5 as follows:

A.D. 1927.

1. (1) The following paragraphs shall be inserted Bonâ fide after paragraph (c) in section five of the Licensing Act, travellers. 1921 :

(d) the sale of intoxicating liquor to be consumed on licensed premises to bonâ fide travellers, except where the licence is a sixday licence and the sale is on Sunday, or the consumption of intoxicating liquor by travellers so supplied; or

(e) the sale at any time at a railway station of intoxicating liquor to persons arriving at or departing from the station by railroad after or before a journey of not less than ten miles, and in the latter case producing railway tickets for the journey, or the consumption of intoxicating liquor by persons so supplied; or (2) The following subsections shall be inserted after paragraph (f) in section five of the Licensing Act, 1921 :(2) If in the course of any proceedings taken against the holder of a justices' licence for contravening the provisions of this Part

of this Act as to closing hours, that person
(in this section referred to as "the defendant ")
fails to prove that the person to whom the
intoxicating liquor was sold (in this section
referred to as the purchaser ") was a bonâ 5
fide traveller, but the court are satisfied that
the defendant truly believed that the pur-
chaser was a bona fide traveller, and further
that the defendant took all reasonable pre-
cautions to ascertain whether or not the pur- 10
chaser was a bonâ fide traveller, the court shall
deal with the case as against the defendant
as if the purchaser had been a bonâ fide traveller,
and if they think that the purchaser falsely
represented himself to be a bonâ fide traveller, 15
the court may direct proceedings to be insti-
tuted against the purchaser under this Part of
this Act.

(3) A person for the purposes of this Part
of this Act shall not be deemed to be a bonâ 20
fide traveller unless the place where he lodged
during the preceding night is at least three
miles distant from the place where he demands
to be supplied with liquor, that distance to be
calculated by the nearest public thoroughfare. 25
2. (1) This Act may be cited as the Licensing
Act, 1927.

(2) This Act shall be construed as one with the Licensing Acts, 1910 and 1921, and those Acts and this Act may be cited together as the Licensing Acts, 1910 30 to 1927.

(3) This Act shall not apply to Scotland.

(4) This Act shall come into operation at the expiration of fourteen days after the passing thereof.
