The QUEEN's Most Excellent Majesty in Council.

THIS day the Right Honourable James Earl of Dalhousie, the Right Honourable Sir Edward Ryan, Knight, and the Right Honourable Thomas Pemberton Leigh, were, by Her Majesty's command, sworn of Her Majesty's Most Honourable Privy Council, and took their respective places at the Board accordingly.

Her Majesty in Council was this day pleased to appoint the Right Honourable William Ewart Gladstone, and, in his absence, the Right Honourable James Earl of Dalhousie, to be President of the Committee of Council appointed for the consideration of all matters relating to trade and foreign plantations.

The QUEEN's Most Excellent Majesty in Council.

WHEREAS the Ecclesiastical Commissioners for England have, in pursuance of an Act, passed in the session of Parliament held in the third and fourth years of Her Majesty's reign, intituled "An Act to carry into effect, with "certain modifications, the fourth report of the

"Commissioners of Ecclesiastical Duties and "Revenues;" and of an Act, passed in the last session of Parliament, intituled "An Act to alter "and amend the law relating to ecclesiastical "houses of residence," duly prepared and laid before Her Majesty in Council a scheme, bearing date the fourth day of April one thousand eight hundred and forty-three, in the words and figures following, viz.:

"We, the Ecclesiastical Commissioners for England, in pursuance of an Act, passed in the session of Parliament held in the third and fourth years of your Majesty's reign, intituled "An Act to

carry into effect, with certain modifications, "the fourth report of the Commissioners of Ecele"siastical Duties and Revenues;" and of an Act, passed in the last session of Parliament, intituled

An Act to alter and amend the law relating to "ecclesiastical houses of residence," have prepared, and now humbly lay before your Majesty in Council, the following scheme, for improving the demesne lands belonging to the see of Hereford.

"Whereas it is by the first-recited Act enacted, that, by the authority therein provided, and for the purpose of fully carrying into effect any of the provisions of the same Act, or of another Act therein recited, any sum of money which shall have been invested in the public funds, or in other security or securities, in trust, for any ecclesiastical body corporate, aggregate, or sole, may, upon an application, in writing, to us, under the hand and-seal of such body corporate, be directed to be sold, and the same shall be sold accordingly, and the produce of such sale shall be applied to such purpose and in such manner as shall appear most conducive to the permanent benefit of such body corporate:

"And whereas by the secondly-recited Act it is, amongst other things, enacted, that whenever it shall appear to be expedient to improve any episcopal house of residence, or the demesnes thereof, it shall be lawful, with the consent, under the hand and episcopal seal of the Bishop, to make such arrangements as may be deemed most expedient for improving any episcopal house of residence, or for improving the demesnes adjoining to any such house, by the purchase of any land, tenement, or hereditament in the immediate neighbourhood, or within the view thereof:

"And whereas it is by the same Act declared and enacted, that the provisions of the first-recited Act, relating to the sale and application of any sum of money invested, in trust, for any ecclesiastical body corporate, do and shall include and apply to all monies and securities for money, and to all stock in the Government funds or elsewhere, standing in the name of the AccountantGeneral of the Court of Chancery or in the name or names of any other public officer, or of any individual or individuals, for or to the credit, or for the benefit of or in trust for, any bishop, whether for the purpose of being laid out in land or otherwise, and that the same provisions do and shall extend and may be applied to any of the purposes of the Act now in recital:

"And whereas certain estates, belonging to or held under the see of Hereford, were sometime since sold and enfranchised under the provisions of certain Acts of Parliament relating to the redemption of the land tax, made and passed in the forty-second and fifty-fourth years respectively of the reign of His late Majesty King George the Third, and the monies arising from such sale and enfranchisement were invested in the purchase of twenty-three thousand three hundred and twelve

pounds, seven shillings, and ten pence, Three Pounds per Centum Reduced Annuities, in the names of the Commissioners for the Reduction of the National Debt, to the account of the sale of the land tax, for the purpose of being applied to the redemption of the land tax charged on the estates and livings belonging to the said see of Hereford:

"And whereas several sums, amounting altogether to the sum of sixteen thousand two hundred and ninety-four pounds, one shilling, and four pence, part of the said sum of twenty-three thousand three hundred and twelve pounds, seven shillings, and ten pence, have been, from time to time, applied in and for the redemption of such land tax, and such land tax has accordingly been redeemed; and there was lately standing in the books of the Governor and Company of the Bank of England, in the names of the said Commissioners for the Reduction of the National Debt, 'the account of the sale of the land tax,' the sum of seven thousand and eighteen pounds, six shillings, and six pence, like Annuities, in trust for the said see of Hereford, being the surplus remaining after such redemption, and the dividends thereof have been, from time to time, paid to the Bishop of Hereford for the time being:

And whereas by a certificate, bearing date the twenty-sixth day of January one thousand eight hundred and forty three, under the hands and seals of three of the Commissioners of your Majesty's Treasury, it was certified, in pursuance of the said Act of the fifty-fourth year of His Majesty King George the Third, that it had been satisfactorily made to appear to them the said Commissioners, that so much of the land tax charged on the estates of the see of Hereford, or on livings in the gift or patronage of the see, had

been redeemed, as under the circumstances of the case they the said Commissioners thought

reasonable :

"And whereas, in pursuance of the said several Acts of Parliament, passed in the forty-second and fifty-fourth years of the reign of His late Majesty King George the Third, and in pursuance of the said certificate, the said Commissioners for the Reduction of the National Debt have caused to be transferred to the AccountantGeneral of the Court of Chancery, with his privity, the sum of seven thousand and eighteen pounds, six shillings, and six pence, Three Pounds per Cent. Reduced Annuities, and the same is now standing in his name in the books of the Governor and Company of the Bank of England, the account of the Right Reverend Thomas Lord Bishop of Hereford :'

"And whereas the lands, tenements, and hereditaments, particularly described in the schedule hereto annexed, are situate on the south bank of the river Wye, and within view of the episcopal house of residence belonging to the said see of Hereford, and it appears to us to be expedient, for the purpose of improving the said house and the demesnes adjoining thereto, which come down to the north bank of the said river, opposite the lands described in the said schedule, that the said lands, tenements, and hereditaments should be purchased and added to the demesne lands of the said episcopal house, so as to become the permanent property of the said see of Hereford:

"And whereas the said lands, tenements, and hereditaments were sometime since purchased by the Right Reverend Thomas Lord Bishop of Hereford, at and for the price and cost to the said Bishop of two thousand five hundred and ninetyseven pounds, seven shillings, and three pence,
