missary, and enclosed under his seal and transmitted to the Board, and shall be received by them as evidence. A witness examined before such commissary may be sworn or affirmed in the manner aforesaid.

SEC. 9. The Board having deliberately considered the evidence, shall declare in a writing signed by them, or a majority of them, their decision on the charges contained in the presentment, distinctly stating whether the accused is guilty or not guilty of such charges respectively, and also stating the sentence which, in their opinion, should be pronounced; and a copy of such decision shall be without delay communicated to the accused; and the original decision, together with the evidence, shall be delivered to the Bishop, who shall pronounce such canonical sentence as shall appear to him to be proper, provided the same shall not exceed in severity the sentence recommended by the Board; and such sentence shall be final. Before pronouncing any sentence, the Bishop shall summon the accused and any three or more of the clergy to meet him at such time as may in his opinion be most convenient, in some church to be designated by him, which shall for that purpose be open at the time to all persons who may choose to attend, and the sentence shall then and there be publicly pronounced by the Bishop. But the Bishop, if he shall be satisfied that justice requires it, may grant a new trial to the accused, in which case a new Board of Presbyters shall be appointed, the proceedings before whom shall be conducted as before mentioned.

SEC. 10. All notices and papers contemplated in this Canon may be served by a summoner or summoners, to be appointed for the purpose by the Bishop, and whose certificate of such service shall be evidence thereof. In case of service by any other person, the fact shall be proved by affidavit of such person. A written notice or paper delivered to a party, or left at his last place of

residence, shall be deemed a sufficient service of such notice or paper. Provided, however, that the service, if not personal, shall be a notice of at least sixty days.

SEC. 11. The accused may have the privilege of appearing by counsel, in case of the exercise of which privilege, and not otherwise, those who present shall have also the like privilege; which counsel shall, in all cases, be members of the Protestant Episcopal Church. SEC. 12. The record of all proceedings upon a presentment of a clergyman shall be preserved by the Standing Committee, and for that purpose shall, after a final decision, be delivered to their clerk.

CANON VIII.

OF CHURCHES LOSING THEIR CONNECTION WITH THE PROTESTANT EPISCOPAL CHURCH IN THIS DIOCESE.

Whenever, hereafter, any church in union with this Convention shall neglect, for three years in succession, to make a parochial report, no missionary report being made in its behalf, and during the same period shall not employ a clergyman as its parish minister, nor obtain the services of a missionary, nor be represented by any delegate or delegates in Convention, such church shall be regarded as having forfeited its connection with the Protestant Episcopal Church in this Diocese, and be no longer entitled to representation in the Convention thereof; but any such church may be re-admitted into such connection on the recommendation of the Bishop, and by a resolution of the Convention; and such readmission shall take effect from and after the rising of the Convention which shall have agreed to the same.

CANON IX.

OF CLERGYMEN'S EXPENSES TO CONVENTION.

It shall be the duty of the Wardens in each Parish to provide, by collection in church or otherwise, for the

expenses of their Rector to and from the Diocesan Convention.

CANON X.

OF THE MISSIONARY FUND OF THE DIOCESE.

There shall be made in each parish a collection in aid of the Missionary fund of the Diocese, quarterly, on the second Sunday in March, June, September and November, and it shall be the duty of the Minister of each parish, or where there is no Minister, of the Church Wardens, to cause such collection to be made on the several days designated, and transmit the sum collected or contributed to the Treasurer of the Diocese.

CANON XI.

OF ALTERATIONS IN THE CANONS.

No proposed alteration of, or addition to, the Canons of this Diocese shall be considered by the Convention, except at a stated meeting, and after one day's notice thereof, given in open Convention; nor (unless by unanimous consent) until it shall have been reported on by a committee of at least two clergymen and three laymen. Nor shall such alteration or addition be adopted during the same Convention, if two-thirds of the members present shall not concur therein; but, in such case, the same (unless negatived by a majority of votes) shall lie over for consideration at the next Annual Convention. Provided, however, that any alteration of, or addition to, the Canons of the Diocese, proposed at any time by the Committee on Canons, may, by unanimous consent, be adopted by the Convention without the giving of one day's previous notice; otherwise the same shall lie over, as aforesaid.

CANON XII.

OF DIFFERENCES BETWEEN MINISTERS AND THEIR

CONGREGATIONS.

SECTION 1. In case of controversy between any Rector or Assistant Minister of a parish, and the Vestry of the same, the parties, or either of them, may apply to the Bishop, who shall nominate seven Presbyters of this Diocese, entitled to seats in the Convention, and cause a list of their names to be served on the Rector or Assistant Minister and Vestry, who shall, within fourteen days after such service, return their respective lists, each party having the right of striking off two names; and should this right not be exercised, or both parties strike off the same names, then the Bishop shall reduce the number of Presbyters to three, two of whom shall constitute a quorum, and shall meet at such time and place as the Bishop may designate, and of which due notice shall be given to the parties concerned, in order that the grounds of the controversy may be fully stated.

SEC. 2. If it appear to a majority of the Board that there is no hope of a favorable termination of the controversy, they shall recommend to such Rector or Assistant Minister to relinquish his connection with such parish, on such conditions as shall appear to them proper and reasonable.

SEC. 3. Should the Rector or Assistant Minister refuse to comply within ten days after the decision shall have been made known to him, he shall be liable to suspension from the exercise of all ministerial functions until he submit to said decision.

SEC. 4. And if the Vestry of the parish refuse or neglect to comply on their part with the decision aforesaid, the said parish shall be prohibited from a representation in the Convention of the Diocese until they shall have performed their duty in accordance with the

same.

CANON XIII.

OF APPOINTING A TREASURER DURING RECESS OF CON

VENTION.

In case the Treasurer die, remove from the Diocese, or resign, the Standing Committee shall appoint a Treasurer to serve until the next succeeding Convention, whose duty it shall be to receive and take possession of all money and evidences of indebtedness, books, papers and property of which his predecessor as Treasurer had charge at the time of such decease, removal or resignation.

CANON XIV.

OF THE REGISTRAR.

SECTION 1. At the annual meeting of the Convention, a Registrar of the Diocese shall be elected, whose duty it shall be to collect, in as detailed a manner, and as far as practicable, and to record in a proper book, to be procured for that purpose, an account of the origin and progress of each parish which has been organized within this Diocese.

SEC. 2. He shall, also, collect and preserve all the published journals, convention sermons, and other printed documents connected with the history and progress of the Diocese.

CANON XV.

OF THE SALARY OF THE BISHOP.

The salary of the Bishop shall be fifteen hundred dollars per annum, which may be increased, but shall not be decreased during the term of his Episcopate.

CANON XVI.

OF THE DETAILING OF RECTORS.

For the purpose of erecting new parishes and strengthening feeble ones, the Bishop or the Assist
