Official Logs.-Sections 239 to 243. Official log-books to be kept, and to be evidence. By whom entries to be signed. Entries of certain matters required in official log-book. Penalty for non-compliance. Destroying or. mutilating or making false or fraudulent entries a misdemeanour. No entry to be made more than twenty four hours after · arrival under fine of £30. Delivery of official log-books to superintendents compulsory. Official logs to be sent home in case of transfer of ship, and in case of loss of ship. Non-compliance and penalty, £10.

Local Marine Boards.-Sections 244, 245. Continuance and constitution of Local Marine Boards in manner specified in Seventh Schedule to Act. Control of Board of Trade over Local Marine Boards. See also Section 74, Merchant Shipping Act, 1906.

Establishment

Mercantile Marine Offices.-Sections 246 to 250. and control of Mercantile Marine Offices by Board of Trade. Business of Mercantile Marine Offices. Embezzlement by officers of Local Marine Boards and punishment. Power of Board of Trade to dispense with transactions of certain matters at Mercantile Marine Offices. Prohibition on taking other than authorized fees at the Mercantile Marine Offices. See also Section 74, Merchant Shipping Act, 1906, repealing parts of Section 246, principal Act, 1894, and placing control of staff of Mercantile Marine Offices solely in Board of Trade. Registration of and Returns respecting Seamen.-Sections 251 to 258. General Register and Record Office of Seamen to be maintained in London. Board of Trade to appoint Registrar-General of Seamen and all officers and servants thereat. Register of seamen to be kept. Lists of the crew to be made out and signed by master of foreign-going and home trade ships containing certain particulars. Lists of foreign-going ships to be delivered to superintendent within forty-eight hours after arrival at final port of destination; of home trade ships, within twenty-one days after June 30 and December 31 in each year. Penalty for non-compliance, £5. Return of births and deaths to be made and transmitted by master. List of crew to be made out and delivered up by owner or master in case of transfer or loss of ship. Penalty for non-compliance, £10. Transmission of lists and all documents to Registrar-General by superintendents and other officers. Deposit of agreement with crew, indentures and assignments of apprenticeship necessary at foreign and Colonial ports in the case of all British ships (excepting passenger ships) with chief officer of Customs or Consular officer within forty-eight hours after arrival. Penalty for noncompliance by master, £20.

Sites for Sailors' Homes.-Section 259. Corporations or other local public bodies empowered to grant sites for Sailors' Homes at any port in the United Kingdom and vest same in trustees.

Application of Part II. of the Act.-Sections 260 to 266. Part II. applies to ships registered in the United Kingdom, subject as hereinafter provided with respect to (a) Ships belonging to any of the three general lighthouse authorities; (b) Pleasure yachts; and (c) Fishing boats. Definition of what provisions apply to ships registered elsewhere than in the United Kingdom. Only partial application of Part II. to ships of lighthouse authorities and pleasure yachts-exemptions defined. Partial application of Part II. to fishing boats, and exemptions. Colonial Legislatures empowered to apply Part II. to Colonies. Unregistered ship deemed to be registered in United King. dom for certain purposes. See also Merchant Shipping Act, 1906.

PART III.-Passenger and Emigrant Ships.

Definition of Passenger and Passenger Steamer.-Section 267. Passenger includes any person other than master and crew, and the owner, his family and servants. Passenger steamer every British steamship carrying passengers to, from, or between any place in the United Kingdom, except steam ferry boats working in chains (commonly called steam bridges") and every foreign steamship carrying passengers between places in the United Kingdom.

Definition of Emigrant Ship.-Sections 268 to 270. Expression Emigrant ship" defined to which this part of Act applies. Scale for determining length of voyages. Definition of Colonial voyage. See also Merchant Shipping Act, 1906.

Passenger Steamers.-Sections 271 to 284. Annual survey of passenger steamers compulsory. Mode of survey and declaration of survey. Transmission of survey declaration to the Board of Trade necessary. and penalty on owners for non-compliance. Issue of passenger certificate by Board of Trade. Appeal to Court of Survey provided for aggrieved owners. Transmission of passenger certificate by Board of Trade for issue. Fees for certificate payable as defined in Part I. of Ninth Schedule to Act. Duration of certificate. Power of Board of Trade to cancel certificate. Delivery up of certificate on expiration or cancellation, and penalty for failure. Passenger certificate to be posted up in conspicuous position in ship, and penalty for failure. Penalty for forgery or fraud in connection with passenger certificate or declaration. Penalty provided for carrying excess passengers. Colonial passenger certificate valid if approved by Order in Council. See also Sections 19 and 22, Merchant Shipping (Convention) Act, 1914.

General Equipment of Passenger Steamers.-Sections 285, 286. Equipment of passenger steamers with compasses, hose, deckshelters, and safety appliances. Penalty provided for default. Prohibition of increasing weight on safety valve beyond fixed survey limits; penalty £100.

Keeping Order in Passenger Steamers.-Sections 287, 288. Offences in connection with passenger steamers by passengers and others, and penalties. Power given to exclude drunken passengers on home trade passenger steamers.

Survey of Emigrant Ships.-Section 289. Preliminary survey of emigrant ships necessary. Time of survey; and failure to comply with requirements punishable by law. See also Section 22, Merchant Shipping (Convention) Act, 1914.

Equipments of Emigrant Ships.-Section 290. Emigrant ship, to be equipped with certain compasses, chronometers, fire-engines, anchors, etc. Penalty for non-compliance.

Number of, and Accommodation for, Passengers.-Sections 291 to 294. Regulations as to carrying passengers generally. Limit of number of steerage passengers not to exceed number stated in regulations in Tenth Schedule to Act. Penalty for excess passengers. Regulations as to accommodation of steerage passengers to be in accordance with Eleventh Schedule to Act, and penalty for non-compliance. Stowage of goods debarred in certain places, and penalty for contravention. See also Merchant Shipping Act, 1906, repealing Section 291. Provisions, Water, and Medical Stores.-Sections 295 to 300. Supply of provisions and water to be of good condition and quality. Extent

of supply and penalty for improper provision. Mode of carrying water defined-penalty for contravention. Provision may be made for touching at intermediate ports to take in water under certain conditions. Issue of water and provisions during voyage, and penalty for failure. Board of Trade may add to dietary scale by notices in London Gazette. Power of Board of Trade to exempt certain ships from this part of Act. Medical stores to be carried: penalty for failure. Section 299 repealed by Merchant Shipping Act, 1906.

Dangerous Goods, and Carriage of Cattle.-Sections 301, 302. Regulations as to carriage of dangerous goods, and of horses and cattle. Vessels not to clear outwards where cargo comes within Explosives Act, 1875, or certain other articles endangering health or life of steerage passengers, or with horses, cattle or other animals carried contrary to conditions of Thirteenth Schedule to Act. Penalty for breach. Carriage of military stores by order of Secretary of State, and penalty for refusal.

Medical Officer, Staff, and Crew.-Sections 303 to 305. A duly authorized medical practitioner shall be carried in an emigrant ship (a) where number of steerage passengers exceeds 50; and (b) where number of persons on board (including cabin passengers, officers, and crew) exceeds 300. Qualification of medical officer, and rating. With steerage passengers, certain stewards, cooks, and interpreters to be carried. Crew of emigrant ship to be efficient and passed by Emigration officer. Penalties for non-compliance. See Section 27, Merchant Shipping Act, 1906.

Medical Inspection.-Sections 306 to 308. Emigrant ship to be subjected to medical inspection of passengers and crew before clearance outwards; penalty for non-compliance. Relanding of persons for medical reasons; penalties for non-compliance. Return of passage money provided for persons relanded for medical reasons.

Master's Bond.-Sections 309, 310. Bond to be given by master of an emigrant ship before clearance. Evidence of bond.

Passengers' Lists.-Sections 311 to 313. List of all passengers in duplicate to be given where ship carries steerage passengers before clearance. Penalty for non-observance. Separate list of passengers embarked after clearance to be rendered under penalty. Attempt to gain passage without payment, and penalty.

Certificate of Clearance.-Sections 314 to 319. Certificate for clearance of emigrant ship to be issued by Emigration officer. Facilities to be given for the inspection of ships, and penalty for failure. Ships putting back to replenish stores, provisions, etc., to be re-examined and obtain clearance certificate in certain cases; penalty for noncompliance. Emigrant ships putting back to be reported to Emigration officer; penalty on master for failure. Appeal to Court of Survey provided for aggrieved owner. Forfeiture of ship proceeding to sea

without certificate for clearance.

Passengers' Contracts.-Sections 320 to 323. Contract tickets for passengers to be provided; penalty for failure to comply. Summary remedy for breach of contract. Penalty on passengers failing to produce contract tickets. Penalty for altering or inducing anyone to part with contract ticket.

Regulations as to Steerage Passengers.-Sections 324 to 326. Subject to sanitary and other regulations by Order in Council. Discipline

on board to be maintained and penalties for breach. Sale of spirits to steerage passengers forbidden on board, and penalty for contravention. Maintenance after Arrival.--Section 327. Steerage passengers to be maintained on board forty-eight hours after arrival in port at end of voyage.

Detention and Wrongful Landing of Passengers.-Sections 328 to 330. Return of passage money and compensation to passengers when passage not provided according to contract. Subsistence money to passengers in case of detention. Penalty for landing steerage passengers at wrong place. See also Merchant Shipping Act, 1906

Provisions in case of Wreck.-Sections 331 to 335. Provisions for passengers in case of an emigrant ship being wrecked or damaged in or near British Islands. Expenses of rescue and conveyance of wrecked passengers. Provision for forwarding of passengers by Governors or Consuls. Receiving of expenses incurred in conveying wrecked passengers from owner, charterer, and master. Validity of insurance of passage money.

Voyages to the United Kingdom.-Sections 336 to 338. Lists of steerage passengers to be brought to British Islands. Number of steerage passengers on ships bringing steerage passengers to British Islands and penalty for excess. Issue of provisions and water in ships carrying steerage passengers to British Islands, and penalty for non-compliance.

Registration of Births and Deaths.-Section 339. Application to foreign ships carrying passengers to and from British Islands of provisions of Part II. re Births and Deaths.

Saving of Right of Action.-Section 340. Saving of right of action to steerage passenger or other person on contract for passage.

Passage Brokers.-Sections 341 to 346. Definition of passage broker. Passage brokers to enter into bond and obtain licence. Granting of licences to passage brokers. Forfeiture of licence by Court. Passage broker agents to hold appointments and penalty for non-compliance. Lists of agents and runners to be exhibited by brokers and sent to Emigration officers. Penalty for non-compliance.

Emigrant Runners.-Sections 347 to 352. Emigrant runners defined. Emigrant runner's licence and regulations. Renewal of badges provided. Penalties on persons acting without licence or badge, using badge not lawfully issued, or employing unlicensed persons. Penalties on emigrant runners for certain acts of misconduct. Emigrant runner's commission and fees and penalties for unauthorized charges on steerage passengers.

Frauds in procuring Emigration.-Sections 353, 354. Punishment for frauds in procuring passages. Penalties for fraud in connection with assisting emigration. Section 353 repealed by Merchant Shipping Act, 1906.

Emigration Officers.—Section 355. In British Islands to be appointed by Board of Trade and in British possessions by Governor.

Legal Proceedings.-Sections 356 to 358. Recovery of fines under this Part of Act. Recovery of passage and subsistence money. pensation and damages may be had in Court of Summary Jurisdiction. Protection of persons executing Act.

PART IV.-Fishing Boats.

Application of Part IV. partly to-(a) All fishing boats and to the whole fishing service; and (b) to all fishing boats of twenty-five tons and upwards; and (c) to fishing trawlers of twenty-five tons and upwards, and where provided, to fishing trawlers of whatever tonnage. Agreements for Fishing Vessels in Scotland.-Section 389. Agreements for fishing vessels in Scotland for payment by share only to apply to that country.
