P. 9. 1. 18. No statute appears to have been passed within the period of the last six sessions, which can properly be referred to this head, save the 57 Geo. 3. c. 55. G. B. which suspends the habeas corpus act in England, and the act for preventing wrongous imprisonment, and against undue delays in trials, in Scotland. Though this statute tried without an is of a temporary nature, yet as it is one which may be from time to time revived or continued, I have thought it 57 Geo. 3.c.55. right to give it a place in this volume. This statute is G. B. intitled "an act to continue an act, to empower his ma"jesty to secure and detain such persons, as his majesty "shall suspect are conspiring against his person and go"vernment:" and the 57 Geo. 3. c. 3. G. B. to which this act refers, recites that a traitorous conspiracy had been formed for the purpose of overthrowing, by means of a general insurrection, the established government, laws, and constitution of this kingdom; and that designs and practices of a treasonable and highly dangerous nature were carrying on in the metropolis, and in many other parts of Great Britain; and the former statute (in like manner as the latter) therefore enacts, that all or any person or persons that are or shall be in prison within Great Britain, at or upon the day on which this act shall receive the royal VOL. assent, (30th June 1817,) or after, by warrant of the privy council, signed by six of said council, for high treason, suspicion of high treason, or treasonable practices, or by warrant signed by any of his majesty's secretaries of state, for such causes as aforesaid, may be detained in safe custody, without bail or mainprize, until the 1st day of March 1818; and no judge or justice of peace shall bail or try any such persons so committed, without order from the privy council, signed by six of said council, until the said 1st day of March 1818. And by s. 2. the act made in Scotland, Act in Scotland in the year 1701, intitled "an act for preventing wrongof '70, so fur as relates to ous imprisonment, and against undue delays of trials, so treason, suspen- far as the same may be construed to relate to cases of treason and suspicion of treason, with respect to persons so committed as aforesaid, shall be suspended until the 1st day of March 1818; and, until said day, no judge, justice of peace, or other officer of the law of Scotland, shall liberate, try, or admit to bail, any person that is or shall be in prison within Scotland, under a warrant so signed, and for such causes as aforesaid, without order of the privy council, signed by six of said council. Provided (s. 3.)
