ceding international act, and shall be read and construed with it as one act. Section 11, after reciting that her Majesty has already, by order in Council, given effect to certain stipulations in the international convention with the French Republic, and that it is expedient that the remainder of the stipulations, on her part, should take effect without further order in Council, enacts, that during the continuance of such Convention, and as long as the present order in Council remains in force, the provisions of the above ten sections of this act shall apply to such Convention, and to the translations of books and dramatic pieces published or represented in France, in the same manner as if her Majesty had issued a further order in Council, in pursuance of this act for giving effect to the Convention, and had directed the above-mentioned period of five years for protection, and period of three months for registration and deposit of such translations. Section 12 gives the sanction of Parliament to the reduction of duties on books, prints, and drawings published in France, which has been already made, pursuant to the Convention, by her Majesty's order in Council.* It also enacts, that such duties, so reduced, shall not be raised during the continuance of the Convention, and that if further reduction be made for other countries, it may be extended to France. La section 13, après avoir mentionné que des doutes se sont élevés sur le sens du tableau des droits sur les * Voyez plus loin. prints, and drawings, which is appended to the 9 & 10 Vict. c. 58, in reduction of such duties, enacts, that for the purposes of the 9 & 10 Vict. c. 58, every work published in the country of export, part of which has been originally produced in the United Kingdom, shall be subject to the duty payable on "works originally produced in the United Kingdom, and republished in the country of export," although it contain also original matter not produced in the United Kingdom; unless it be satisfactorily proved to the Commissioners of Customs that the original matter is at least equal to the part produced in the United Kingdom, in which case the works shall be subject only to the duty on "works not originally produced in the United Kingdom." Section 14, after referring to the four acts which constitute copyright in engravings, and after reciting that doubts are entertained as to whether the provisions of those statutes extend to lithographs and other impressions, declares that those four acts are intended, and are to be construed to include prints taken by lithography or any other mechanical process by which prints or impressions of drawings or designs are capable of being multiplied indefinitely. The statutes themselves will be found in an appendix at the end of the book. THE INTERNATIONAL COPYRIGHT CONVENTION BETWEEN ENGLAND AND FRANCE. THIS Convention, the most important that has yet been entered into since the passing of the International Copyright Act, was effected at Paris at the latter end of the last, and the beginning of the present year. It affords reciprocal protection and right of property to the respective productions of either country in literature, the drama, music, engraving, and sculpture. The Convention, which is based on the English and French law of copyright, consists of fifteen articles and a final procés verbal. These articles may be summarily detailed as follow: Article 1 fixes the nature and extent of the International copyright. Articles 2, 3, give copyright to translators in translations of their own productions, and fix the conditions of such copyright. Article 4 extends the copyright in such translations to the performance of dramatic and musical productions. Article 5 permits translations from newspapers, under certain restrictions. |
