AN ACT to further amend the Roads Act, 1902.

[Assented to 24th December, 1904.]

BE it by, consent of the Legislative Council

E it enacted by the King's Most Excellent Majesty, by and

and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:

1. This Act may be cited as the Roads Act Amendment Act, Short title. 1904 (No. 2), and shall be read as one with the Roads Act, 1902, hereinafter referred to as the principal Act.

2. Section one hundred and seventeen of the principal Act is Amendment of sec. hereby amended by inserting in subsection (31) after the word "jetties," the words "bathing enclosures."

3. Section one hundred and seventy-three of the principal Act Amendment of sec. is hereby amended by striking out subsection one, and inserting the following in lieu thereof:

173. (1.) The board of any district to which Part VII. applies may make or pave footways, and with the consent of

the Minister construct and maintain sea or river jetties, bathing enclosures, and bathing-houses, and may pay the expense incurred thereby out of their general revenue.

4. [97.] (1.) The Governor may, by Order in Council, appoint the Board a Drainage Board for any drainage district constituted within the road district.

(2. Upon the publication of such Order in Council in the Government Gazette, the following provision shall apply:

(a.) The Board may, within the drainage district, exercise the powers and shall perform the duties of a Drainage Board elected under the provisions of the Land Drainage Act, 1900.

(b.) All drains and drainage works constructed within the drainage district under the said Act shall be vested in the Board.

(c.) The members of any Drainage Board appointed or elected for such district under the provisions of the

said Act, and the officers of such Board, shall go out of office.

(d.) The assets, liabilities, contracts, and engagements of the Drainage Board shall become vested in, and shall attach to the Road Board, and may be recovered and enforced by or against the Road Board.

5. All copies of the principal Act hereafter printed by the Government Printer shall be printed as amended by this Act, under the supervision of the Clerk of the Parliaments, and a reference to this Act made in the margin.

AN ACT to enable Coventry Parade and Christina Parade, North Fremantle, to be dedicated to the public.

Assented to 24th December, 1904.]

E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:

1. Notwithstanding the provisions of section two hundred and twenty-one of the Municipal Institutions Act, 1900, it shall be lawful for the council of the municipality of North Fremantle to dedicate Coventry Parade and Christina Parade, in the said municipality, to the public use; and after publication of notice thereof in the Government Gazette, such dedication shall be deemed to be valid and complete, and such streets shall thereupon become public streets within the meaning of the said Act.
