125 "SUBSEQUENT FELONY:" Jurisdiction of Sessions-Indictment-Effect of C Justice Act upon subsequent Felonies.] It will be observed by the statute 5 & 6 V 38, s. 1 (ante, p. 973), that, although in every other class of offence punisha transportation for life it takes away the jurisdiction of the quarter sessions, it con the power to award the punishment of transportation [now penal servitude, 20 & 2 c. 3, s. 2, ante, p. 1005] for life, for a subsequent felony. The punishment for larceny only, after a previous conviction for felony, is not so severe as in this ca will be seen by Offence 290, ante, p. 1110, yet the "offences made punishabi simple larceny," Nos. 298, 301, 305 to 309, when either of them is the subse felony, are punishable in the higher degree. The 27 & 28 Vict. c. 47, s. 2, ante, p. provides, that the least sentence of penal servitude that can be awarded for a subse felony is a period of seven years. Venue.] The venue in treason committed in England may be laid in any county in which a good overt act can be proved (Arch. Cr. Pl. by Bruce, 16th ed. p. 673). Treason out of the realm may be tried either before the Court of Queen's Bench, by a jury of the county where the court sits, or by commission in any county therein named, by a jury of such county (35 Hen. 8, c. 2; Arch.
