CERTAIN AIRCRAFT COMPONENTS AND MATERIALS; DUTY EXEMPTION

Pub. L. 94-511, Oct. 15, 1976, 90 Stat. 2440, provided:

"That in the case of any aircraft which"(1) was previously exported from the United States,

"(2) was composed, at the time of such exportation in part of components and materials which are products of the United States and which were installed“(A) while such aircraft was within the United States, and

"(B) after such aircraft was operational,

"(3) is returned to the United States after being so exported without having been advanced in value or improved in condition by any process of manufacture or other means while abroad, and

"(4) was entered for consumption before 1970 pursuant to an entry which is unliquidated as of the date of the enactment of this Act [Oct. 15, 1976], the rate of duty provided for in item 694.40 of the Tariff Schedules of the United States (19 U.S.C. 1202) on the date of such entry shall, notwithstanding any other provision of law, be assessed upon the full value of such aircraft less the value of such components and materials. For the purposes of this Act, the value of any such component or material is the cost of such component or material at the time of installation in the aircraft plus the cost of such installation.

"SEC. 2. No entry may be liquidated as provided for in the first section of this Act unless request therefor is filed with the customs officer concerned on or before the thirtieth day after the date of the enactment of this Act [Oct. 15, 1976]."

ENTRIES OR WITHDRAWALS OF ARTICLES ADVANCED OR IMPROVED ABROAD

Pub. L. 89-806, § 1(b), Nov. 10, 1966, 80 Stat. 1522, provided for the liquidation or reliquidation of articles advanced or improved abroad which entered or were withdrawn from warehouse after Aug. 30, 1963, and before Nov. 10, 1966.

(a) any jewelry or similar articles of personal adornment having an aggregate value of $300 or more which have been exempted from duty under item 812.10 is sold within 3 years after the date of importation, or

(b) any article which has been exempted from duty under item 812.30 is sold within 1 year after the date of importation, or

(c) any automobile exempted from duty under item 813.25 is used otherwise than for the purpose therein expressed or is not returned abroad within the time and manner prescribed by the Secretary of the Treasury,

without prior payment to the United States of the duty which would have been payable at the time of entry if the article had been entered without the benefit of any of these items, such article, or its value (to be recovered from the importer), shall be subject to forfeiture. An article sold pursuant to a judicial order or in liquidation of the estate of a decedent shall not be subject to the provisions of this note.

2. In the case of persons arriving from a contiguous country which maintains a free zone or free port, if the Secretary of the Treasury deems it necessary in the public interest and to facilitate enforcement of the requirement that the exemption in item 813.31 shall

apply only to articles acquired as an incident of the for-
eign journey, he shall prescribe by regulation or in-
struction, the application of which may be restricted to
one or more ports of entry, that such exemption shall
be allowed only to residents who have remained beyond
the territorial limits of the United States for not less
than a specified period, not to exceed 24 hours, and,
after the expiration of 90 days after the date of such
regulation or instruction, allowance of the said exemp-
tion shall be subject to the limitations so prescribed.
3. A person arriving in the United States-

(a) on duty as an employee of a vessel, vehicle, or
aircraft, engaged in international traffic, or

(b) from a trip during which he was so employed
shall not be entitled to the exemptions provided for in
this subpart (other than those in item 814.00), unless he
is permanently leaving such employment without the
intention of resuming it on the same or another carrier.
Articles imported by or for the account of any person arriv-
ing in the United States from a foreign country:

Books, libraries, usual and reasonable furniture, and Free
similar household effects, if actually used abroad by
him or by him and his family not less than one year,
and not intended for any other person, or for sale.
Professional books, implements, instruments, and tools Free
of trade, occupation, or employment, which have been
taken abroad by him or for his account.
Articles by or for the account of any person emigrating
from a foreign country to the United States:

Subpart C-Personnel of Foreign Governments and
International Organizations; Distinguished Visitors
Subpart C headnotes:

1. The term "baggage and effects", as used in this sub-
part, includes all articles which were in the possession
abroad, and are being imported in connection with the
arrival, of a person and which are intended for his bona
fide personal or household use, but does not include ar-
ticles imported as an accommodation to others or for
sale or other commercial use.

2. The privileges of item 821.00 are limited to such personal effects and equipment as are necessary for the occasion and temporary visit, and are to be exported no later than 30 days after the conclusion of the public demonstration.

3. The term "articles entered for the personal or family use", as used in this subpart, does not include articles imported as an accommodation to others or for sale or other commercial use.

4. The privileges provided for in this subpart for rep-
resentatives, officers, employees, and members of the
armed forces, of foreign governments, their families,
suites, and servants, shall be accorded only if their gov-
ernment grants reciprocal privileges to United States
personnel of comparable status.
