HEREAS complaints are made that many horses are exported by persons other than their true owners, and that no means exist for checking such wrongful exportation, for prevention thereof be it enacted by His Excellency the Governor of Western Australia and

1. This Act may be cited as 'The Exportation of Horses Act, short title 1874.'

2. From and after the passing of this Act it shall not be lawful to export any horse or horses from this Colony without authority in writing from the Resident Magistrate of the port from which such horse or horses is or are to be exported, or in the absence of such Resident Magistrate from some Justice of the Peace resident in or near such port permitting the exportation of the same. Any person exporting any horse without having obtained such written authority for the exportation of the same shall be guilty of an offence, and on being convicted thereof in a summary manner by two Justices of the Peace, shall forfeit and pay a sum not exceeding twenty pounds for each and every horse so Penalty exported.

3. The Resident Magistrate of any port from which it may be proposed to export any horse or in the absence of such Resident Magistrate any Justice of the Peace resident in or near such port, shall on application from the person proposing to export the same, and on receiving from him a description of such horse or horses and of any brands or other marks upon the same, grant to such person a written authority for such exportation. Such written authority shall sanction only the exportation of such horse or horses as answer the description given in the application, and shall on the exportation of such horses be given up to the police constable or other person authorised to receive the

same.

An Act to amend The Elementary Education Act, 1871.' (35 Vic., No. 14.)

WHE

WHEREAS it is expedient to amend 'The Elementary Education. Act, 1871,' with reference to the support of Government Schools and the limitation of Grants to Assisted Schools: Be it enacted by His Excellency the Governor of Western Australia and its

An Act to facilitate the Proof of Telegraphic Messages in Courts of Justice, and for other purposes.

[Assented to 17th July, 1874.

THEREAS it is desirable to facilitate the proof of telegraphic Preamble
messages in Courts of Justice, and to extend the advantages

of the electric telegraph: Be it therefore enacted by His Excellency
the Governor of Western Australia and its Dependencies, by and
with the advice and consent of the Legislative Council thereof, as
follows:-

1. It shall be lawful for any party to any action or suit in any Court of civil jurisdiction, at any time after the commencement thereof, to give notice to any other party that he proposes to adduce in evidence at the trial or hearing of such action or suit any telegraphic messages that before the date of such notice shall have been received by electric telegraph in Western Australia: Provided that the time between the giving of such notice and the day on which such evidence shall be tendered shall not in any case be less than two days before the day of such hearing or trial; and every such notice shall specify the names of the sender and receiver of such messages, the subject matter thereof, and their dates as nearly as may be; and any such notice may be
