Acte pour amender un Acte de la dernière Session du Parlement pour pourvoir temporairement au gouvernement du Bas-Canada.

TTENDU qu'un Acte a été passé dans la trente-unième année du Règne de Sa Majesté le Roi George Trois, intitulé, "Acte qui rappelle certaines parties d'un Acte passé dans la quatorzième année du Règne de Sa Majesté, intitulé, "Acte qui pourvoit plus efficacement pour le Gouvernement de la Province de "Québec dans l'Amérique Septentrionale, et qui pourvoit plus amplement pour le "Gouvernement de la dite Province," par lequel, entre autres choses, il a été statué qu'il y aurait dans chacune des Provinces du Haut-Canada et du Bas-Canada respectivement, un Conseil Législatif et une Assemblée, à être constitués d'après les moyens y prescrits, et avec tels pouvoirs et autorités qui y sont spécifiés : Et attendu qu'un Acte a été passé dans la dernière Session du Parlement, intitulé, "Acte qui 1 & 2 Vict. c. 9 pourvoit temporairement au Gouvernement du Bas-Canada," par lequel il a été statué, que, du moment de la Proclamation de l'Acte au premier jour de Novembre, mil huit cent quarante, la partie du dit Acte de la trente.unième année du Règne de Sa Majesté le Roi George Trois, et d'aucun autre Acte ou Actes du Parlement, qui pourvoit à la constitution ou convocation d'un Conseil Législatif ou Assemblée pour la Province du Bas-Canada, ou qui leur confère aucun pouvoirs ou fonctions, cessât; Et que par le dit Acte maintenant cité il est pourvu dans l'intervalle à la nomination par Sa Majesté d'un Conseil Spécial pour les affaires du Bas-Canada, et à la passation de Lois ou Ordonnances pour le Gouvernement de la dite Province par le Gouverneur d'icelle, de l'avis et consentement de la majorité des Conseillers présents à aucune Assemblée du Conseil ; Et attendu qu'il est expédient que quelques unes des dispositions contenues dans le dit Acte cité en dernier lieu soient changées; Qu'il soit donc Statué par Sa Très-Excellente Majesté la Reine,

II. And be it enacted, That from and immediately after the passing of this Act, vision of 1 & 2 so much of the said recited Act passed in the last Session of Parliament as provides that no Law or Ordinance made by the Governor of the said Province of Lower Canada, with such Advice and Consent as therein mentioned, shall continue in force beyond the First day of November, one thousand eight hundred and forty-two, unless continued by competent authority, shall be and the same is hereby repealed: Provided always, that every Law or Ordinance which by the Terms and Provisions thereof shall be made to continue in force after the said First day of November, one thousand eight hundred and forty-two, shall be laid before both Houses of Parliament within thirty days after a Copy thereof shall be received by one of Her Majesty's Principal Secretaries of State, under the Provisions of the said Act of the last Session of Parliament, if Parliament shall be then sitting, or otherwise within thirty days after the then next Meeting of Parliament; and no such Law or Ordinance shall be confirmed or declared to be left to its Operation by Her Majesty until such Law or Ordinance shall first have been laid for Thirty days before both Houses of Parliament, or in case either House of Parliament shall, within the said Thirty days, address Her Majesty to disallow any such Law or Ordinance.

III. And be it enacted, That from and immediately after the passing of this Act, so much of the said recited Act passed in the last Session of Parliament, as provides that it shall not be lawful, by any such Law or Ordinance as therein mentioned, to impose any tax, duty, rate or impost, save only in so far as any tax, duty, rate or impost which at the passing of that Act was payable within the said Province of Lower Canada, might be continued, shall be and the same is hereby repealed: Provided always, that it shall not be lawful for the said Governor, with such advice and consent as aforesaid, to make any Law or Ordinance imposing or authorising the imposition of any new tax, duty, rate or impost, except for carrying into effect local improvements within the said Province of Lower Canada, or any District or other local Division thereof, or for the establishment or maintenance of Police, or other objects of Municipal Government, within any City or Town or District or other local Division of the said Province: Provided also, that in every Law or Ordinance imposing or authorizing the imposition of any such new tax, duty, rate or impost, provision shall be made for the levying, receipt and appropriation

par et de l'avis et consentement des Lords Spirituels et Temporels et des Communes en ce présent Parlement assemblés, et par l'autorité d'iceux, que le nombre des Conseillers composant le Conseil Spécial de la manière pourvue par le dit Acte passé dans la dernière Session du Parlement ne sera pas moins de Vingt, et qu'il ne sera transigé aucune affaire à aucune assemblée du dit Conseil moins onze Spécial à laquelle il n'y aura pas au moins Onze Conseillers présents.

II. Et qu'il soit statué, Qu'aussitôt après la passation de cet Acte, sera comme est par le présent révoqué l'Acte ci-dessus cité, passé dans la dernière session du Parlement, en autant qu'il pourvoit qu'aucune Loi ou Ordonnance faite par le Gouverneur de la dite Province du Bas-Canada, de l'avis et consentement mentionnés en icelui, ne continuera pas à demeurer en force au delà du Premier jour de Novembre, mil-huit-cent-quarante-deux, à moins qu'elle ne soit continuée par une autorité compétente: Pourvu toujours que toute Loi ou Ordonnance qui d'après ses termes et dispositions sera faite pour continuer en force après le dit Premier jour de Novembre, mil-huit-cent-quarante-deux, sera mise devant les deux Chambres du Parlement sous trente jours après la réception d'une copie d'icelle par un des Principaux Secrétaires d'Etat de Sa Majesté, en vertu des dispositions du dit Acte de la dernière session du Parlement, si le Parlement siége dans le temps, si non sous trente jours après la réunion alors prochaine du Parlement; et aucune telle Loi ou Ordonnance ne sera confirmée ou déclarée être laissée à son opération par Sa Majesté jusqu'à ce que telle Loi ou Ordonnance ait été d'abord mise pendant Trente jours devant les deux Chambres du Parlement, ni dans le cas où l'une ou l'autre Chambre du Parlement demandera par adresse à Sa Majesté de désavouer toute telle Loi ou Ordonnance.

appropriation thereof by such person or persons as shall be thereby appointed or designated for that purpose, but that no such new tax, rate, duty or impost shall be levied by or made payable to the Receiver General or any other public Officer employed in the receipt of Her Majesty's ordinary Revenue in the said Province; nor shall any such Law or Ordinance as aforesaid provide for the appropriation of any such new tax, duty, rate or impost by the said Governor, either with or without the advice of the Executive Council of the said Province, or by the Commissioners of Her Majesty's Treasury, or by any other Officer of the Crown employed in the receipt of Her Majesty's ordinary Revenue.

IV: And be it enacted, That from and after the passing of this Act, so much of the said recited Act passed in the last Session of Parliament, as provides that it shall not be lawful for any such Law or Ordinance as therein mentioned, to repeal, suspend or alter any provision of any Act of the Parliament of Great Britain, or of the Parliament of the United Kingdom, or of any Act of the Legislature of Lower Canada, as then constituted, repealing or altering any such Act of Parliament, shall be and the same is hereby repealed: Provided always, that it shall not be lawful for the said Governor, with such advice and consent as aforesaid, to make any Law or Ordinance altering or affecting the Temporal or Spiritual Rights of the Clergy of the United Church of England and Ireland, or of the Ministers of any other Religious Communion, or altering or affecting the Tenure of Land within the said Province of Lower Canada, or any part thereof, save so far as the Tenure of Land may be altered or affected by any Law or Ordinance which may be made by the said Governor, with such advice and consent as aforesaid, to provide for the extinction of any Seignorial Rights and Dues now vested in or claimed by the Ecclesiastics of the Seminary of Saint Sulpice of Montreal within the said Province, or to provide for the extinction of any Seignorial Rights and Dues vested in or claimed by any other person or persons, or Body or Bodies Corporate or Politic, within the Island of Montreal, or the Island called Ile Jesus, within the said Province.

V. And be it enacted, That every Law or Ordinance to be made by the said be published in Governor, with such advice and consent as aforesaid, shall, before the passing or enactment thereof, be published at length in the public Gazette of the said Province of Lower Canada.

Et qu'il soit statué, Qu'aussitôt après la passation de cet Acte, sera comme il est par le présent révoqué l'Acte ci-dessus cité passé dans la dernière session du Parlement, en autant qu'il pourvoit qu'il ne sera loisible par aucune Loi ou Ordonnance telle qu'y mentionnée, de révoquer, suspendre ou changer aucune d'aucun Acte disposition d'aucun Acte du Parlement de la Grande-Bretagne, ou du Parlement du Royaume-Uni, ou d'aucun Acte de la Législature du Bas-Canada, telle qu'alors constituée, révoquant ou changeant aucun tel Acte du Parlement: Pourvu toujours qu'il ne sera loisible au dit Gouverneur de l'avis et consentement susdits, de faire aucune Loi ou Ordonnance changeant ou affectant les droits spirituels ou temporels du Clergé de l'Eglise Unie d'Angleterre et d'Irlande, ou des Ministres d'aucune autre Communion Religieuse, ou changeant ou affectant la Tenure des Terres dans la dite Province du Bas-Canada ou d'aucune partie d'icelle, sauf en autant que la Tenure des Terres pourra être changée ou affectée par aucune Loi ou Ordonnance qui pourra être faite par le dit Gouverneur, de l'avis et consentement susdits, pour pourvoir à l'extinction d'aucuns droits et redevances sei. gneuriaux dont sont investis ou que réclament les Ecclésiastiques du Séminaire de St. Sulpice de Montréal dans la dite province, ou pour pourvoir à l'extinction d'aucuns droits et redevances seigneuriaux dont sont investis ou que réclament aucune autre personne ou personnes, ou corps politiques ou incorporés, dans la dite Ile de Montréal, ou l'Ile appelée Ile Jésus, dans la dite Province. Et qu'il soit statué, Que toute Loi ou Ordonnance qui sera faite par le dit Gouverneur de l'avis et consentement susdits, sera, avant sa passation en loi, (passing or Enactment) publiée au long dans la Gazette Publique de la dite Province du Bas-Canada.

VI. Et qu'il soit statué, Que pour les fins de cet Acte la personne autorisée à exécuter la Commission de Gouverneur de la Province du Bas-Canada, sera prise pour le Gouverneur d'icelle.

VII. Et qu'il soit statué, Que cet Acte pourra être amendé ou révoqué par aucun Acte qui sera passé dans la présente Session du Parlement.
