Preamble.

An Act to repeal certain clauses of the "Customs Act
1857" and to substitute others in lieu thereof.
[18th September 1860.]

HEREAS by the one hundred and twenty-third and one hundred and twenty-fourth sections of the "Customs Act 1857" the provisions relating to the "coasting trade" have been extended to vessels trading to or from any port of Victoria or of Vide 16 & 17 Vict. any other Australasian colony: And whereas such extension is an

infringement of the power vested by the Imperial Parliament in Her Majesty in Council: Be it therefore enacted by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows:

1. The one hundred and twenty-third and one hundred and twenty-fourth sections() of the said recited Act shall be and the same are respectively hereby repealed.

2. All trade by sea from any one port of the colony to any coasting trade. other port thereof shall be deemed to be a coasting trade, and all ships while employed therein shall be deemed to be coasting ships within the meaning of the said Act and every other Act relating to the customs.

3. If any goods shall be taken into or put out of any coasting ship at sea or if any coasting ship shall deviate from her voyage unless forced by unavoidable circumstances, the master of such ship shall forfeit the sum of one hundred pounds.

the Commissioners of Trade and Customs, and observations of the Board of Trade, on the subject of these enactments.

and for other purposes.

E it enacted by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say) :—

1. 5. Any person who shall falsely make any declaration, or who shall fraudulently evade or attempt to evade any of the provisions of this Act, or who shall infringe any of the regulations to be made as hereinbefore mentioned, shall be liable to a penalty of Fifty pounds; and the gold in respect of which such offence shall have been committed shall be forfeited.

6. No proceedings of any nature or kind whatsoever shall be portation of gold commenced or taken against any persons who before the passing of not the produce this Act shall have exported or advised authorised or been privy to the exportation of any gold not being the produce of the said colony brought by sea from any place beyond the said colony to any port in the said colony for or by reason of such persons not having paid the duty on such gold; nor shall any such gold be forfeited.
