38. Any proclamation made under this Act may be explained varied revoked annulled or superseded by any other such proclamation published subsequently to the one to be so explained faried revoked annulled or superseded A copy of the Government Gazette giving one month's notice of the intention to make every such proclamation under this Act shall be laid before both Houses of Parliament before such proclamation shall take effect.

39. Nothing in this Act shall apply to any person using a landing net to secure fish caught with a rod and line, nor to any fixed engine used solely for catching eels, nor to any person using a hand shrimp net, nor to any aboriginal native taking fish for his own use, nor to any person taking fish in water of which he is the owner, nor to any person authorized by such owner to take fish in such water, nor to any person with the written permission of the Commissioner of Customs catching fish for the bonâ fide purpose of removing them to stock other waters, nor to any nets engines or boats used or fish taken by such person, nor to any person who having unintentionally taken any fish contrary to the provisions of this Act shall immediately return the same with as little injury as possible to the water.

An Act to Consolidate the Law relating to Friendly 28 VICTORIA, Societies. [9th May 1865.]

BE it enacted by the Queen's Most Excellent Majesty by and with

the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows:

1. This Act shall come into operation on the first day of June Title of Act. in the year of our Lord One thousand eight hundred and sixty-five. It shall be called and may be cited as the "Friendly Societies Statute 1865" and is divided into Parts as follows :—

PART I.-Formation and Registration of Societies ss. 4-14.
PART II.-Powers Rights and Proceedings of Societies and
Members ss. 15-41.

2. The Acts mentioned in the First Schedule hereto to the Repeal of Acts. extent to which the same are in and by the said schedule expressed First Schedule. to be repealed shall be and the same are hereby repealed. All rights and exemptions given or continued and preserved under or by any of the Acts hereby repealed, and the effect given by any of the said Acts to any receipts, and all appointments made shall continue and have the same force as if this Act had not been passed. All registrations completed and rules and alterations made under any of the said repealed Acts before the coming into operation of this Act shall be deemed to have been completed and made respectively under this Act. Every existing society established before the coming into operation of this Act under any of the Acts hereby repealed shall be deemed to have been established under and shall continue and be within the provisions of this Act and shall enjoy and be subject to all the exemptions privileges and conditions of this Act as fully as if such societies and the rules thereof had been certified and registered under this Act. In case the rules of any such society shall not have been certified in accordance with the provisions of any of the said repealed Acts before the coming into operation of this Act in the manner and for the purposes in and by any of the said Acts required, the same shall within six months after the commencement of this Act be certified by the certifying barrister under the provisions of this Act.

3. In the interpretation of the provisions of this Act, unless Interpretation inconsistent with or repugnant to the context, the following expressions shall have the meanings hereby assigned to them (that is to say) :

4. Any number of persons amounting to ten or more may establish a society under the provisions of this Act for the purpose lished for certain of raising by voluntary subscriptions of the members with or without the aid of donations a fund for any of the following objects (that is to say):

(1.) For the relief maintenance or endowment of a member or the husband wife child or kindred of a member in infancy old age sickness widowhood or any natural state of which the probability may be calculated by way of average:

(11.) For defraying the expenses of the burial of a member his or her wife husband or child subject to the restrictions hereinafter contained:

(III.) For insuring a sum to be paid on the death of a member to the person nominated in a writing to be deposited with the secretary of the society by such member being the husband wife father mother child brother sister nephew or niece of such member or in default of such nomination or in case of the death of such nominee to be paid to the executor or administrator or next of kin of the member:

(IV.) For insuring or making good any loss or damage of live or dead stock goods implements of trade and tools sustained by any member by fire flood shipwreck or other contingency of which the probability may be calculated by way of average:

(v.) For the frugal investment of the savings of members for the better enabling them to purchase food firing clothes or other necessaries or to purchase or hire any implement material or article of use or necessity in their trade calling or business or to provide for the education of their children or kindred: Provided that the shares in any such investment society shall not be transferable and that the investment of each member shall accumulate or be employed for the sole benefit of such member investing or of the husband wife children or kindred of such member and of no other person and that the whole amount of the balance due to such member according to the rules of such society be paid to him on withdrawing from such society:

(VI.) For the purpose of enabling any member or the husband wife or children or nominee of such member to immigrate to Victoria and of enabling the immigrants to purchase the tools implements materials or other necessaries of their trade calling or business and of advancing loans to them for any such purpose and taking such security for the repayment thereof as the trustees of the society may think fit:

(VII.) For raising a fund to assist the members in obtaining a freehold or leasehold property or to purchase land for and on behalf of the members to be subdivided amongst them :
