I HAVE endeavoured to make this edition of the Indian Contract Act a practical guide and interpreter to the working of the Act, and not a mere chaotic collection of reported cases. With this object in view, I have avoided citing English cases, unless they illustrate the application of a principle adopted in the Act. Rather, I have attempted to explain the Act by comparison of one Section with another, by showing how the general rules enacted should be applied to particular classes of cases falling under them, and by as complete a critical examination of the Code as I could give within the proper compass of such a work. The index has been prepared, and the proof-sheets of the whole work have been corrected, by my friend Mr. F. Clarke, Barrister-at-Law and officiating Receiver of the High Court of Calcutta. My best thanks are due to this gentleman for the assistance he has thus given to me, and I have much pleasure in expressing my appreciation of the excellent manner in which he has performed his share of the work.
