(a) In this case the value of the property seized, condemned, and sold, being less than $250, the whole of the costs, agreeably to the provisions of the 5th section of the act alluded to, are to be taken out of the United States moiety, that being sufficient for that purpose; when, in such case, such moiety is not sufficient to pay the costs, the other parties interested in the forfeiture are to pay the balance, and not the United States. Note. In all cases the taxable costs and charges are to be supported by bills regularly allowed and taxed by court. If any of the charges of the marshal, &c., which are not taxable by court, should appear to you to be unauthorized or excessive, they are, of course, to be rejected or reduced, as the case may be. It is also to be observed, that the marshal's account of sales should specify the articles sold, to whom sold, quantity, prices obtained, &c., and should be accompanied, in each case, by a copy of the decree of court, certified by the clerk. 1821.
