ARTICLES of the Capitulation demanded by Major De Labene, in the Englifh Troops, and Commander of the Castle of Ghent.

1. THAT the English Magazine fhall go out with the Garrifon. Granted, Three Pieces of Canon, but nothing out of the Magazine, except Ammunition for 12 Shots each Picce.

II. That the Garrifon fhall go out with Arms and Baggage, and with all the Marks of Honour, to be conducted to the nearest Garrison belonging to the High-Allies, with a fufficient Guard, and by the fhorteft Way. Granted, to be conducted to the SasVan-Ghent, by Water.

III. That the Commander of the Caftle fhall remain within the faid Caftle till Tuesday next, with his Garrifon; and that he shall deliver up the Antwerp-Gate, next Monday, in the Afternoon, to Monfieur de Chemerault, Lieutenant-General in his Moft Christian Majesty's Armies. He fhall deliver up the Gate on Sunday the 8th inftant, at 8 a-Clock in the Morning.

IV. That during that Time, no Hoftility fhall be committed, either from the City against the Castle, or from the Castle against the City. Granted.

V. That all the Women belonging to the English Army, that are at prefent in the City of Ghent, fhall go out with the Garrifon, with their Move, ables and Baggage, without any Molestation. Granted.

VI. That, during that Time, no Batteries fhall be rais'd on either fide, neither in the City, not in the Caftle. Granted.

VII. That all Officers belonging to the Garrison of the faid Castle, that have either Moveables or Baggage in the City of Ghent, fhall have the fame reftored to them; nor fhall the fame be detained upon any Pretence whatsoever. Granted, upon the Word of Honour of the Commander.

VIII. That Carriages fhall be furnish'd to the faid Officers, either by Land or by Water, they paying the ufual Prices. Granted, Boats to be conducted to the Sas-van-Ghent, paying for the fame.

IX. That the Services which the City of Ghent is ufed to pay,fhall be paid to the faidCommander of the Castle, and to the Officers of his Garrifon. Granted:

X. And in cafe the faid Commander of the Castle be relieved between this and Monday next, before Noon, the faid Capitulation to be void. Granted, till the 8th inftant, at 9 a-Clook in the Morning, in cafe the Confederate Army fhould come to relieve him within the limited Time.

At a Confultation of Officers, held in the Castle of Ghent, on Friday, the 6th of July 1708, Major Lewis de Labene being Commander in Chief, it was agreed upon, that the faid Castle was not tenable twenty four Hours, in Cafe of an Attack; and having receiv'd two Summons from the Enemy the Day before, with Affurances of their lofing no time to attack us, and being likewife inform'd, that they were preparing every thing for that purpose, we thought it proper to come to a Capitulation: The Reafons why we judg'd it not tenable, are as follows:

1.THE Strength of the Enemy, which we were inform'd, confifted of 6000 Men, the fame Day they made themfelves Mafters of the ⚫ Town,

Town, and the next Day they receiv'd a Rein'forcement of to Battalions, and a ftrong Body of Horfe, wherewith we found our felves quite furrounded, and, by that means, deprived of all Hopes of being reliev'd, having, at the fame time, re⚫ceiv'd Advice, that their whole Army was within two Leagues of the Town, and fo pofted, that it would be impoffible for our Army to help us.

2. Our Number of Men confifted of Recruits and weak fickly Men, just come from the Hofpital. 3. "There being a large old Breach already made, which, for a confiderable Space, had not fo much as a Palifade to secure it.

4. "The Moat in that Place being fordable, and the Enemy having a Conveniency of coming close 'to the Moat, juft over against the Breach, without Discovery.

5. Our Cannon being in a manner useless for 'want of Neceffaries thereunto belonging, Mr.Jones, the Store-Keeper being out of the Way, and alfo the Gunners, notwithstanding they had Lodging for 'em in the Castle.

6. The vaft Number of Women and Children, which amounted to upwards of 900, and, at the fame time, the Scarcity of Provifions, by which we were reduc'd to fome Extremity and having taken all these Things into Confideration, we thought it proper to comply with thefe Terms, believing, that in cafe we were not reliev'd by the Time limited in the Capitulation, we could not hope for any at all.
