PREFACE

TO THE THIRD VOLUME.

In the account of the alterations which have been made in Practice and Pleading, I have endeavored to keep in view the original design of the Commentaries, and to avoid entering into details which would be useless to the student or general reader, and for which the practitioner must always consult works intended exclusively for his use. For the same reason, I have, in the other parts of the volume, contented myself with stating how the Law has been altered by statutes or modern decisions, and, except in a few instances, have abstained from adding to or amplifying the text. My object throughout has been to compress the matter contained in the notes so that they might not distract the reader's attention unnecessarily, and might enable him, without difficulty, to learn both what the Law has been and what it now is. The notes to the Chapter on Proceedings in the Courts of Equity were prepared by my learned friend Mr. Hargrave, it being a subject which I did not feel myself qualified to deal with. I have only to add my regret that, in consequence of the principal portion of the third volume having gone early to press, I have been unable in that part to notice the cases which have been decided lately; but I believe that none of them have been such as to render it necessary for me to alter what I had written.
